Attorney General Bonta issues guidance to protect immigrant communities

California Attorney General Rob Bonta has issued a new package of legal guidance to help state and local law enforcement, prosecutors, and defense counsel uphold state laws designed to protect immigrant communities. The announcement comes as concerns grow over potential federal immigration policies under the incoming administration.

Bonta reaffirmed California’s commitment to immigrant rights, emphasizing that state resources will not be used for federal immigration enforcement. “No matter who is in the White House, California will continue to lead with California values,” he said in a statement.

Key Measures Under the New Guidance

The Attorney General’s guidance addresses several critical areas:

  • Law Enforcement Restrictions Under SB 54: Also known as the California Values Act, SB 54 prohibits state and local law enforcement from using resources for immigration enforcement, including detaining individuals based solely on immigration status or sharing release dates with federal agencies.
  • Legal Protections in Plea Deals: Prosecutors and defense attorneys are required to inform defendants about potential immigration consequences of plea agreements, ensuring fair legal representation.
  • Hate Crime Resources: In response to anticipated increases in hate crimes targeting immigrant communities, the Attorney General has provided new tools for law enforcement, prosecutors, and victims to address such crimes effectively.

In an ongoing effort to support immigrants, Bonta has been hosting regional meetings with immigrant rights groups and elected officials in major California cities, including Los Angeles, San Francisco, and Sacramento, to discuss protections and resources. The Attorney General’s office has also released multilingual materials to educate immigrants about their rights.
